Moniq Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Moniq mobile application, website, and related services (the "App" or "Service"). The Service is published and operated by Moniq Finance, an individual developer ("Moniq," "we," "us," "our," or the "Developer").

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Moniq Is and Is Not

Moniq is a personal finance tracking and budgeting tool. It helps users manually record, categorize, organize, and visualize income, expenses, budgets, and spending analytics for informational and organizational purposes only.

Moniq is not:

Moniq does not hold, move, transfer, lend, invest, or manage user funds. Any budgets, summaries, calculations, insights, projections, or visualizations shown in the App are based on data provided by the user and are for informational purposes only. You are solely responsible for your financial decisions and should consult a qualified professional before making financial, tax, legal, investment, or credit-related decisions.

2. Eligibility and Accounts

You may use Moniq only if you:

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information when registering and keep it up to date.

We may suspend or terminate your access if you violate these Terms, create legal or security risk, misuse the Service, or if we are required to do so by law.

3. User Content and Financial Data

You retain ownership of the financial records, notes, categories, budgets, and other content you enter into the App ("User Content").

You grant us a limited, non-exclusive, worldwide license to host, store, process, display, and transmit your User Content solely as necessary to operate, maintain, secure, and improve the Service.

You are responsible for the accuracy, completeness, and legality of the data you enter. Moniq does not verify user-entered data and does not guarantee that calculations, totals, budgets, categories, analytics, or insights are accurate, complete, current, or suitable for any particular purpose.

If Moniq later supports linking third-party financial accounts, such linking will be optional, require your explicit consent, and be subject to the terms and privacy practices of the relevant third-party provider.

4. Privacy, Data Retention, and Deletion

If you create an account, you may request deletion of your account and associated personal data through the App, if available, or by contacting us at help@moniq-support.com.

When an account is deleted, we will delete or anonymize personal data associated with the account from active systems within the period described in the Privacy Policy. Some data may be retained for a limited period where necessary for security, fraud prevention, backups, legal compliance, dispute resolution, tax/accounting obligations, or enforcement of these Terms. Aggregated or anonymized data that does not identify you may be retained indefinitely.

Moniq is currently provided as a free app. We do not charge users, sell subscriptions, offer paid features, process in-app purchases, or accept payments through the App.

7. Third-Party Services

The Service may use third-party services such as cloud hosting, authentication, analytics, crash reporting, push notifications, or customer support tools. These services may process data as described in our Privacy Policy.

We are not responsible for third-party services, websites, SDKs, or content that are not controlled by us. Your use of third-party services may be subject to their own terms and privacy policies.

8. Intellectual Property

The App, Service, software, design, interface, trademarks, logos, text, graphics, and other materials, excluding your User Content, are owned by the Developer or licensed to the Developer and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the Service, except as expressly permitted by these Terms or applicable law. You may not use Moniq branding without our prior written consent.

9. App Store Terms

If you download Moniq from the Apple App Store, you also agree to comply with the applicable Apple App Store terms and policies. Apple is not responsible for providing maintenance or support for the Service, except as required by applicable law. Support requests should be directed to help@moniq-support.com.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, the Developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, loss of data, loss of goodwill, business interruption, financial loss, or losses arising from decisions made based on information displayed in the Service.

To the maximum extent permitted by law, because the Service is currently provided free of charge, our total liability for any claim related to the Service will not exceed USD 100, or the minimum amount required by applicable law, whichever is higher.

This limitation applies only to the extent permitted by applicable law and does not limit liability that cannot be limited by law.

To the extent permitted by law, you agree to indemnify and hold harmless the Developer and service providers assisting with the operation of the Service from claims, damages, liabilities, losses, and expenses arising from:

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access if you violate these Terms, create security or legal risk, misuse the Service, or if continued operation of the Service is no longer commercially, technically, or legally feasible.

After termination, your right to use the Service ends. Sections 4, 8, 10, 11, 12, 14, and 15 will survive termination where applicable.

14. Governing Law and Disputes

These Terms are governed by the laws of the European Union, unless mandatory consumer protection law in your country of residence provides otherwise.

Any dispute will be resolved by the competent courts of the European Union, unless applicable law gives you the right to bring a claim in another jurisdiction or requires another dispute resolution process.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the App, by email, or by another reasonable method before the changes take effect, where required by law.

The updated Terms will apply from the effective date stated in the updated version. If you do not agree to the updated Terms, you should stop using the Service and may delete your account.
